GENERAL AND SPECIAL WARRANTY CONDITIONS

I. GENERAL WARRANTY CONDITIONS


1. General

These warranty conditions apply to Medion Electronics ltd only in conjunction with the general conditions of sale and terms and conditions ("terms") at the time of purchasing the equipment. The current version of these terms are available on the home page of Medion Electronics ( http://www.medion.com.au).

The warranty is effective from the day of purchase of the device from Medion or an official trading partner of Medion and covers defects relating to workmanship and manufacture that may occur during normal use. The warranty period is subject to a proof of purchase from an authorized Medion trading partner.

Please keep your original proof of purchase and warranty card safe. Medion and its authorized service partners reserve the right to refuse a warranty repair or warranty confirmation if a valid proof of purchase cannot not produced.

If it is necessary to return your product for repair please ensure that your product is suitably packed for transportation.

Please insert a detailed error description with the device. To make a claim and before returning your device, please contact the Medion hotline. You will receive a reference number and instructions of how to arrange the return.

Unless otherwise instructed by a MEDION representative in all cases, the product must be returned complete with all parts which were included with the original product. An incomplete receipt of the consignment may result in a delay to your repair or exchange. Medion assumes no liability for peripherals submitted which were not part of the original delivery.

This warranty does not affect your existing, statutory rights and is subject to the laws of the country in which the first purchase of the device was made by the end-user from the authorized dealer of Medion and applies only to this country.

2. Scope
In the event of a defect covered by this warranty Medion ensures the warranty repair or replacement of the Medion device. Medion  will make the decision between repair or replacement of equipment. To that extent Medion may, at their own discretion, decide to replace a device submitted for warranty repair with a device of similar quality.

No warranty is given for batteries or rechargeable batteries or for consumable materials subject to wear and tear, i.e. for parts which have to be replaced periodically during the normal use of the product, such as video-projector lamp.

Non critical failures that fall within industry specified tolerances e.g. noise, LCD pixels are not covered by this warranty. Please consult the appropriate section in your user or instruction manual for this product for exact specifications and tolerances.

To the extent which is permitted under law, MEDION will accept no liability for burnt-in images on plasma or LCD products as a result of normal wear and tear during the operation of the product. Please refer to your user or instruction manual for this product for detailed operating instructions for your plasma or LCD product.

The warranty does not cover errors relating to the playback of data media in an incompatible format or created with unsuitable software.

If it is found during repair or assessment that the defect concerned is not covered under warranty, MEDION reserves the right to invoice you for all reasonable costs incurred by MEDION. These costs will be in relation to the return of the product, including reasonable administration costs, plus reasonable costs for materials used and labour provided when repairing or replacing the product. This is subject to MEDION providing you with an estimate for carrying out such work prior to costs being incurred and that you have accepted the estimate.
You are entitled to seek independent advice or consultation relating to your product or any of MEDION’s findings. MEDION will not be liable for any costs incurred to you when doing so.

3. Exclusions
Failures and damages to the device caused by external influences, accidental damage, misuse, changes made to the equipment, upgrades, use of foreign parts, neglect, viruses or software faults, improper transport, improper packaging or loss during the return of the device to Medion, are not covered by the warranty.

The warranty will be invalidated if the error on the device is caused by maintenance or repair carried out by someone other than Medion or a service partner authorized by Medion. The warranty will also be void if labels or serial numbers of the device or components are modified or illegible.

4. Service Hotline
Before returning your device to Medion we recommend that you contact the service hotline for further information on how to make a warranty claim. .

The service hotline is available on 362 days in the year, including Sundays and bank holidays but excluding Christmas day, New Years Day and Easter day. The service hotline is subject to national rate telephone call charges. These charges are subject to change.

The service hotline does not provide user training for software, hardware or support for third-party products and does not serve as a replacement for reading the manual.

II. Special terms for MEDION PC, notebook, Pocket PC (PDA) and appliances with navigation capability (PNA)


Should any of the supplied goods have a defect, you have a claim for repair or replacement. The warranty covers material and labour costs for the repair of the Medion device.

The warranty can be invalidated if damage results from the addition of any hardware that is not produced or distributed by Medion.

We provide a limited warranty for software. This applies to a pre-installed operating system and  supplied programs. The software supplied on media such as floppy disks and CD-ROMs by Medion or an official trading partner of Medion is guaranteed to be free from defects in materials and workmanship for a period of 90 days after purchase. All software is provided without warranty except for the media upon which this software is supplied upon. Medion will replace any defective media free of charge; any further claims are excluded. Medion does not guarantee that this software will work flawlessly or without interruptions, or that it will meet your needs. We assume no responsibility for the accuracy of maps provided with navigation devices.

It may be necessary to delete all data in the product in order to repair the Medion product. PLEASE MAKE SURE THAT YOU HAVE A BACKUP COPY OF ALL DATA ON THE PRODUCT BEFORE RETURNING THE PRODUCT TO MEDION. To the extent permitted by law, Medion excludes all liability for loss of data and Medion recommends in all cases that you back up all data on your product before returning your product for repair. Medion assumes no liability for the cost of software configuration, lost revenue, loss of data or software, or other consequential damage.
